ORDER: As stated in its prior Orders on June 8 and 9, 2026, the Court advised the parties that it "will not entertain further motions from the parties until the Court resolves Defendants' pending motions" 16 or any forthcoming motion to dismiss 18 . The Court reiterated on June 17, 2026, that it would not entertain further motions 52 . Between June 18, 2026, and June 30, 2026, Plaintiff filed thirty-four documents to the docket in this matter, twelve of which are motions. The Court finds that Plaintiff violated the Court's prior orders and therefore DENIES Plaintiff's pending motions #58 #60 #62 #73 #74 #76 #77 #82 #83 #84 #85 #86 #91 . The Court has also screened Plaintiff's motions labeled as "emergency" motions and finds no reason to deviate from its prior orders cited above. In accordance with its prior orders, the Court also DENIES Defendants' Request to File Supplemental Brief In Support of Motion for Pre-Filing Order #67 . Defendants' Motion for Pre-Filing Order #13 and Motion to Suspend Case Management and Response Deadlines #15 are under advisement. Ordered by Judge Amy M. Baggio. ORDER: The Court STRIKES Plaintiff's Second Amended Complaint 38 , Third Amended Complaint 39 , and Fourth Amended Complaint 40 . Under Federal Rule of Civil Procedure 15(a), a party may amend its pleading "once as a matter of course" but in all other cases, "a party may amend its pleading only with the opposing party's written consent or the court's leave." Here, Plaintiff already amended his complaint once as a matter of course #6 . Additionally, Plaintiff did not seek the Court's leave to file the above-cited amended pleadings. Nor is it clear that Plaintiff obtained Defendants' written consent. Accordingly, the Court strikes the above-cited amended pleadings. The operative pleading in this matter remains Plaintiff's amended complaint in docket entry #6 .Additionally, on June 8 and 9, 2026, the Court advised the parties that it "will not entertain further motions from the parties until the Court resolves Defendants' pending motions" 16 or any forthcoming motion to dismiss 18 . In the following days, Plaintiff filed thirty-two documents to the docket in this matter, three of which are motions. By filing these motions, the Court finds that Plaintiff violated the Court's prior order and therefore DENIES them #21 #49 #51 . The Court adds that, even if it were to review Plaintiff's "Emergency Triple Motion for Preliminary Injunction" #21 , Plaintiff does not sufficiently show that he will be irreparably harmed if Defendants proceed with arguments which Plaintiff argues are "false representations." ORDER: The Court DENIES Plaintiff's Motions for Judicial Notice #9 #10 because Plaintiff fails to supply the Court with the necessary information it needs to conclude that such notice is mandatory. Fed. R. Evid. 201(c)(2). Further, many of Plaintiff's requested documents, such as "[t]he S.J.D. dissertation-length standards published in Harvard Law School's official Graduate Program Handbook" and the "page counts, filing dates, and ECF numbers of all identified filings" appear to be unnecessary for purposes of this litigation. See Jackson v. Med. Bd. of Cal., 424 F. App'x 670 (9th Cir. 2011) ("We deny as unnecessary the request to take judicial notice of the motions filed with the district court.").The Court also DENIES Plaintiff's Motion to Remand #11 . Under 28 U.S.C. 1447(c), a district court has the authority to remand an action to the state court from which it was removed for either (1) "lack of subject matter jurisdiction" or (2) any other defect. The Court finds that Plaintiff's operative pleading alleges violations of his rights under the United States Constitution and various federal statutes. Accordingly, the Court has jurisdiction under 28 U.S.C. 1331. The Court does not find any other defect warranting remand of this matter. The Court also DENIES Plaintiff's Motion to Recuse #12 . Plaintiff has not demonstrated that an objective third-party observer would perceive that the Court is influenced by bias, and Plaintiff has not offered evidence to indicate that there is a reasonable basis to question the Court's impartiality. See 28 U.S.C. 455(a) ("Any justice, judge, or magistrate judge of the United States shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned."); United States v. Hernandez, 109 F.3d 1450, 1453 (9th Cir. 1997) (holding that the standard for recusal is whether "a reasonable person with knowledge of all the facts would conclude that the judge's impartiality might reasonably be questioned"). Instead, here, Plaintiff's basis for his motion appears to be his disagreement with the Court's decisions that were adverse to his position. Recusal on such grounds is not proper. See Liteky v. United States, 510 U.S. 540, 555 (1994) ("[J]udicial rulings alone almost never constitute a valid basis for a bias or partiality [recusal] motion.... Almost invariably, they are proper grounds for appeal, not for recusal."). The Court also finds Plaintiff's citation to United States v. Sears, Roebuck & Co., 785 F.2d 777 (9th Cir. 1986), inapplicable because this matter has not been remanded from the United States Court of Appeals for the Ninth Circuit. See id. at 780 ("Ordinarily, further proceedings in a case remanded to the district judge are conducted by the judge who originally tried the case.").The Court additionally reminds Plaintiff of his deadlines to respond to Defendants' pending Motion to Dismiss #5 which is June 16, 2026, and Defendant's Motion for Pre-Filing Order #13 which is June 22, 2026. The Court will not entertain further motions from the parties until the Court resolves Defendants' pending motions. Ordered by Judge Amy M. Baggio.
