July 7, 2009 Opinion or Order Filing 42 ORDER: Taking into account the weight of defendant's structural conflict of interest in the review of the administrative record, the court finds that LINA administrators did not abuse their discretion in denying plaintiff long-term disability benefits. Therefore, Defendant's Motion for Summary Judgment 28 is granted; and plaintiff's Motion for Summary Judgment 20 is denied. This case is dismissed. Signed on July 7, 2009 by Chief Judge Ann L. Aiken.
