Accordingly, Defendants Motion for Summary Judgment 280 is denied in part and granted in part. Summary judgment is denied as to Plaintiffs claim for excessi ve force premised on the September 19, 2010 altercation with Defendant Payne; Plaintiffs claim for unconstitutional conditions of confinement based on Defendants Harris and Freemans alleged refusal to issue Plaintiff dry clothes during the winter mon ths of 2010 and 2011; and Plaintiffs First Amendment retaliation claim against Defendant Palmer. The Court grants summary judgment to Defendants on all other claims, including Plaintiffs claims against the Doe Defendants. IT IS SO ORDERED.
