Filing 160 ORDER: The court construes Plaintiff's Motion for Assignment of an Investigator #57 ,as a motion for a court-appointed expert witness under Fed. R. Evid. 706(a). So construed, the Court DENIES the motion on the basis that Rule 706 does not contemplate court appointment and compensation of an expert witness as an advocate for a party. Faletogo v. Moya, Case No. 12cv631 GPC (WMC), 2013 WL 524037 at *2 (S.D. Cal. Feb. 12, 2013). The court DENIES Plaintiff's Motion to Compel #88 . The court find Plaintiff's request for any and all internal emails written by, or addressed to, any of the named Defendants which mention the Plaintiff dated anytime between January 2011 and the present to be overly broad and unduly burdensome. The court finds Plaintiff's request for "each and every Form CD 1382 Code of Ethics forms signed by each and every Defendant as a requirement of their employment by the Oregon Department of Corrections" is not proportional to the needs of the case, seeks documents not relevant to the claims in this case, and seeks documents unlikely to lead to the discovery of admissible evidence. The Court hereby accepts Plaintiff's "Reply to Defendants' Reply to Plaintiff's Response to Defendants' Motion for Summary Judgment" #156 and Defendants' "Response to Plaintiff's Reply" #157 . The court takes the parties' cross motions for summary judgment #75 , #101 , and #142 , as well as Plaintiff's requests for injunctive relief #31 , #59 , #81 , and #93 UNDER ADVISEMENT as of 3/12/2018.
