OPINION AND ORDER: Judge Russo's Findings and Recommendation 77 is adopted in part and rejected in part. Because there are sufficient facts in the summary judgment record for a reasonable trier of fact to find that defendant Davis was acting under color of law and that his actions violated Plaintiffs 4th and 14th Amendments rights, Defendant Davis motion for summary judgment is denied. Defendant Michael Maffeis motion for summary judgment is granted. Plaintiffs motion for summary judgment as to the unlawful ouster claim against defendants Harvey Maffei and Denyce Shorb is granted.
