ORDER: Defendants' Motion to Dismiss 27 is granted in part and denied in part. Defendants motion to dismiss for lack of subject-matter jurisdiction is denied. Defendants motion to dismiss for failure to state a claim is granted. Plai ntiffs RICO claims are therefore dismissed without prejudice. The Court defers any decision regarding its exercise of supplemental jurisdiction over Plaintiffs remaining state-law nuisance claims pending a status conference with the parties.
