ORDER OF DISMISSAL. Based on the foregoing, this Court DISMISSES Gibson's Complaint (ECF No. #1 ). Because it is clear that Plaintiff cannot cure the deficiencies in the Complaint by amendment, the Court DENIES leave to amend and DISMISSES this action. For the reasons set forth above, this Court certifies that any appeal taken from this order would not be taken in good faith. See 28 U.S.C. 1915(a)(3); FED. R. APP. P. 24(a)(3)(A). IT IS SO ORDERED. ORDER: The Court GRANTS Plaintiff's Application to Proceed In Forma Pauperis (ECF No. #2 ). The Oregon Department of Corrections ("ODOC") shall collect from Plaintiff's trust account an initial partial filing fee in the amount of $23.69 and forward the funds to the Clerk of Court. ODOC shall collect the balance of the filing fee and forward the funds to the Clerk of Court, in accordance with the formula set forth above, until a total of $350.00 has been collected and forwarded to the Court. IT IS ORDERED that the Oregon Department of Corrections, Central Trust Unit, shall collect payments from the trust account of Plaintiff and shall forward those payments to the Clerk of the Court.
