Order: The Complaint alleges the same facts and issues that were originally plead in Bowerman et al v. St. Charles Health Sys., Case No. 6:23-cv-01488-MC. "Res judicata, also known as claim preclusion, bars litigation in a subsequent action of any claims that were raised or could have been raised in the prior action" GP Vincent II v. Est. of Beard, 68 F.4th 508, 514 (9th Cir. 2003) (citation omitted). Because this action involves the same identity of claims and claims and a final judgment on the merits, Plaintiff's claims are therefore barred by res judicata. See Stratosphere Litig. L.L.C. v. Grand Casinos, Inc., 298 F.3d 1137, 1143 n.3 (9th Cir. 2002) (listing elements of res judicata doctrine); Stewart v. U.S. Bancorp, 298 F.3d 965, 957 (9th Cir. 2002) ("A dismissal for failure to state a claim on which relief may be granted serves as a final judgment on the merits."). Ordered by Judge Michael J.
