July 24, 2026 Opinion or Order Filing 32 ORDER by Judge Mustafa T. Kasubhai: Before the Court is Plaintiff's "Emergency Motion - Protective Order and Sanctions for Witness Intimidation." ECF No. #22 . Plaintiff complains that Defendant Joe Miles threatened to report Plaintiff to the police if Plaintiff continued emailing Defendant Staffing Partners. Plaintiff asks the Court to prohibit Defendant from contacting law enforcement, to cease communication with Plaintiff except through counsel, and for sanctions. Plaintiff cites the Court's inherent authority; the All Writs Act, 28 USC 1651(a); and Rule 65. The Court finds that Plaintiff has not produced sufficient evidence of abuse of the legal process or "witness intimidation" to grant the relief he seeks. Moreover, a Court may issue a temporary restraining order without notice to an adverse party only if "(A) specific facts in an affidavit or a verified complaint clearly show that immediate and irreparable injury, loss, or damage will result to the movant before the adverse party can be heard in opposition; and (B) the movant's attorney certifies in writing any efforts made to give notice and the reasons why it should not be required." Fed. R. Civ. P. 65(b). Plaintiff satisfies neither requirement here. Plaintiff's motion is DENIED. (Deposited in outgoing mail to pro se party on 07/24/2026.) (bd)

June 9, 2026 Opinion or Order Filing 17 ORDER by Judge Mustafa T. Kasubhai: Before the Court are Plaintiff's Motion for Recusal (ECF No. #13 ), Request to Process IFP #2 (ECF No. #15 ), and Emergency Motion for Protective Order (ECF No. #16 ). With respect to recusal, 28 U.S.C. 455 requires a judge to recuse himself "in any proceeding in which his impartiality might reasonably be questioned," including if they have "a personal bias or prejudice concerning a party." 28 U.S.C. 455(a), (b)(1). In evaluating whether recusal is appropriate, the question is "whether a reasonable person with knowledge of all the facts would conclude that the judge's impartiality might reasonably be questioned." United States v. Studley, 783 F.2d 934, 939 (9th Cir. 1986). The Court has reviewed Plaintiff's motion and supporting evidence and finds that a reasonable person with knowledge of the facts would not question this Court's impartiality. Plaintiff's Motion for Recusal is DENIED. Plaintiff's "Request to Process IFP #2" is DENIED as moot because the Court granted Plaintiff's IFP application several days before this motion was filed. See ECF No. #15 . Turning to Plaintiff's Emergency Motion for Protective Order, citing Rule 26(c) and the Court's inherent authority, Plaintiff asks the Court to: (1) enjoin any arrest of Plaintiff at the Wayne Morse Federal Courthouse; (2) enjoin any law enforcement officer from executing any warrant against Plaintiff while he is appearing in or traveling to this Court; (3) permit Plaintiff to appear remotely (via videoconference) for all proceedings in this action; and (4) seal Plaintiff's address and identifying information from the public docket. None of the authorities Plaintiff cites authorize the Court the interfere with Plaintiff's criminal case or cases or to enjoin the conduct of non-parties to this litigation. Plaintiff likewise fails to state good cause for permitting remote appearance (though the Court also notes there are no upcoming hearings that would require in person attendance) or sealing Plaintiff's name and address. May 22, 2026 Opinion or Order Filing 12 ORDER by Judge Mustafa T. Kasubhai: The Court notes that it has received an unreasonably high volume of email correspondence from Plaintiff over the past several weeks. The volume of emails the Court has received from Plaintiff is impeding its ability to manage the Court's docket and ensure all litigants are afforded timely access to justice. For example, last week, the Court received a total of 68 emails from Plaintiff. On May 1, 2026, this Court received 32 emails from Plaintiff in a single day. Plaintiff's emails do not seek the Court's assistance but instead consist of improper demands. "Federal courts possess certain 'inherent powers,' not conferred by rule or statute, 'to manage their own affairs so as to achieve the orderly and expeditious disposition of cases.'" Goodyear Tire & Rubber Co. v. Haeger, 581 U.S. 101, 107 (2017) (quoting Link v. Wabash R. Co., 370 U.S. 626, 63031 (1962)). Here, because Plaintiff's email correspondence is interfering with this Court's ability to expeditiously manage its cases, the Court restricts Plaintiff's use of the Court's email addresses (including [email protected]) to one email per day.
