December 18, 2023 Opinion or Order Filing 3 ORDER THAT 1. If they seek to proceed with claims in this case, Zumar DuBose and Kariem DuBose must complete and return the Declaration attached to this Order within thirty (30) indicating that they have read the Complaint and wish to be parties to this case.2. Zumar DuBose, Kariem DuBose and Abdush DeBose each must within thirty (30) days file a motion to proceed in forma pauperis with a certified copy of his prisoner account statement (or institutional equivalent) showing all deposits, withdrawals, and a current balance, from any correctional facility in which he was confined for the six-month period from June 8, 2023 to December 8, 2023, reflecting account activity from that time period. In the alternative, any named Plaintiff may remit $405 (comprising the $350 filing fee and $55 administrative fee) to the Clerk of Court within thirty (30) days of the date of this Order. Only one payment totaling $405 is required; the Court expresses no direction on how any person listed in the Complaint shall assume the responsibility to make the payment. Any money paid toward the fees is not refundable, even if this case is dismissed. If the full $405 payment is not received, every Plaintiff that opts to continue with this lawsuit by returning an application to proceed in forma pauperis and prisoner account statement, will each be separately responsible for payment of a $350 filing fee in installments, which will be deducted from that persons prisoner account as required by 28 U.S.C. 1915(b). No portion of that fee will be refunded even if this case is dismissed. 3. TheClerk of Court is DIRECTED to send a blank copy of this Courts current standard prisoner in forma pauperis form bearing the above civil action number, to Zumar DuBose, Kariem DuBose, and Abdush DeBose and note the mailing on the docket. No summons shall issue at this time.4. In the event the filing fee is paid, the Clerk shall not issue summonses until so ORDERED, so that the Court may screen the Complaint pursuant to 28 U.S.C. 1915A.5. If the filing fee is not paid, and if any of the Plaintiffs fail to file a motion to proceed in forma pauperis with a certified copy of his prisoner account statement, he may be dismissed from this case without further notice for failure to prosecute. In addition, if Zumar DuBose and Kariem DuBose do not return the Declaration forms, they may be dismissed from this case without further notice for failure to prosecute.6. If the Plaintiffs mailed the Complaint to this Court in error, they may advise theCourt that they wish to voluntarily withdraw the case. SIGNED BY HONORABLE JOHN R.
