Filing 10 ORDER THAT 1. The United States's motion to substitute (DI 4) is GRANTED in part nunc pro tunc: the Clerk of Court is DIRECTED to ADD the United States as a party to the case; Kati Graham-Parker and The Family Practice and Counseling Network-The Health Annex shall remain as defendants in the case pending Ms. Phinisee's response to the United States's motion to substitute and dismiss (DI 9); and the government's request to respond to Ms. Phinisee's complaint on or before February 28, 2024 is DENIED as moot. 2. In light of representations made to the court by Ms. Phinisee and the United States, the deadline for Ms. Phinisee to respond to the United States's motion to substitute and dismiss (DI 9) is EXTENDED to April 10, 2024. In her response, Ms. Phinisee must address who the correct defendants are inher case. In other words, she must state whether Kati-Graham Parker and The Family Practice and Counseling Network-The Health Annex should remain as defendants, or whether the United States is the only proper (and remaining) defendant, and why. Also, in light of the United States's representation in its status report, see DI 6 5-6, Ms. Phinisee shall state whether she intends on pursuing her lawsuit.3. Based on the arguments made by the United States in its motion to dismiss and substitute, as well as the exhibits thereto, see DI 9-2, 9-3, 9-4, the Clerk of Court is DIRECTED to REMOVE as defendants from the case the following parties: Alan Flake, M.D., Randolph Matthews, M.D., Binita Kamath M.D., Avani Shah M.D., Childrens Hospital of Philadelphia, Drexel University, Kai Pittman, Laura Oppenheim, Gwendolyn Nissel-Marshall, Susan Engles, Hannah Cramer, Patricia Haygood, Christine Jaslar, Ruth Weisberger, and the Hospital of the University of Pennsylvania.
