ORDERED: Plaintiffs motion for leave to proceed in forma pauperis (DI 5) is GRANTED pursuant to 28 U.S.C. 1915. Dante S. McKnight, #042308, shall pay the full filing fee of $350 in installments, pursuant to 28 U.S.C. 1915(b), regardless of the outcome of this case. The Court directs the Warden of Lancaster County Prison or other appropriate official to assess an initial filing fee of 20% of the greater of (a) the average monthly deposits to Mr. McKnights inmate account; or (b) the average monthly balance in Mr. McKnights inmate account for the six-month period immediately preceding the filing of this case. The Clerk of Court is DIRECTED to send a copy of this Order to the Warden of Lancaster County Prison. The Amended Complaint is DEEMED filed. The Clerk of Court is DIRECTED to add the following individuals as Defendants in this case, consistent with the Amended Complaint: Cheryl Steberger, Warden; Charlie Stevens, Investigator; Lieutenant Lenard; and Kennedy, Mail Clerk. The Amended Complaint is DISMISSED WITHOUT PREJUDICE for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2)(B)(ii) for the reasons stated in the Courts Memorandum. Mr. McKnight may file a second amended complaint no later than November 6, 2023. The Clerk of Court is DIRECTED to send Mr. McKnight a blank copy of the Courts form complaint for a prisoner filing a civil rights action bearing the above civil action number. etc... ORDER THAT If Mr. McKnight seeks to proceed with this action he must, no later than September 29, 2023, either (1) pay $402 (the $350 filing fee and $52 administrative fee) to the Clerk of Court, or (2) file a motion to proceed in forma pauperis with a certified copy of his prisoner account statement (or institutional equivalent) showing all deposits, withdrawals, and a current balance, from any correctional facility in which he was confined for the six-month period from February 21, 2023 through August 21, 2023, reflecting account activity from that time period. The Clerk of Court is DIRECTED to mail Mr. McKnight a blank copy of this Courts current standard prisoner in forma pauperis form bearing the above civil action number. Additionally, if Mr. McKnight seeks to proceed by way of a civil rights complaint in this Court, he must file an amended complaint no later than September 29, 2023. Upon the filing of an amended complaint, the Clerk shall not make service until so ORDERED by the Court. The Clerk of Court is DIRECTED to mail Mr. McKnight a blank copy of the Courts form complaint for a prisoner filing a civil rights action bearing the above civil action number, which he may use to file an amended complaint.
