GRANTED in all respects as to DefendantSwatara Township;B. GRANTED as to Dfts Bogdanovic and Umberger as to all of Pltfs claims under the 14th Amendment;C. DENIED as to Pltfs claims under the First Amendment arising out of Pltfs speech concerning Sgt Donald Brinks falsification of his police logs, and the May and June of 2007 discipline that followed; andD. GRANTED as to all other claims f or liability under the First Amendment.E. The mtn is DENIED WITHOUT PREJUDICE on the issue of Dfts claim of qualified immunity.(2) Consistent with footnote 3 in the accompanying memorandum,Dfts shall file with the clerk of court a corrective entry to the exhibitsattached to Document 32, so that those exhibits match the pagination and numbering of the courtesy copy of the exhibits supplied by Dfts atty to the court.(3) The clerk of court shall defer entry of judgment until after trial inthis matter.(4) In the near future, the court will issue a new scheduling ordersetting a date for trial, as well as an order addressing the pending motions in limine.
