Filing 7 REPORT AND RECOMMENDATION; IT IS RECOMMENDED that Plf's Oct 4, 2008 8th Amendment conditions of confinement claim against defts Chiles and Beard regarding the cleanliness of his RHU cell be dismissed pursuant to 28 USC Sec1915(e)(2)(ii). Also, we recommend that deft Beard be dismissed entirely from this case. We recommend that Plf's First Amendment free exercise of religion and access to courts claims, and his claims relating to verbal harassment and being issued false misconduct rep orts, be dismissed. Further, we recommend that plf's Oct 4, 2008 8th Amendment excessive force claim against deft Kelsoe be allowed to proceed. Additionally, we recommend that plf be allowed to proceed with respect to his 8th Amendment condition s of confinement claim against Defts Chiles and Kelsoe only for their alleged failure to feed him on numerous occasions from Sept 16, 2008 thru Oct 10, 2008, including six consecutive days without food, which resulted in his loss of over 20 pounds. F inally, we recommend that this case be remanded to the undersigned for further proceedings as against defts Chiles and Kelsoe, including the granting of plf's ifp motion (Doc 2) and directing service of his complaint on the stated two defts.
