November 17, 2010 Opinion or Order Filing 28 REPORT AND RECOMMENDATION re 15 MOTION for Summary Judgment filed by At&T Mobility, LLC - For the reasons set forth above, it is hereby RECOMMENDED that the Court GRANT Defendants Motion for Summary Judgment (Doc. 15) with respect to Plaintiffs ret aliation claims and Plaintiffs claim that Defendant discriminated against him with respect to the provision of an adjustable desk and proximity to restroom facilities. It is further recommended that the Court DENY Defendants motion for summary judgm ent with respect to Plaintiffs claim that Defendant discriminated against him by failing to accommodate his medical needs by reassigning him to another position with the company for which he was qualified, but deny this motion without prejudice to th e parties further addressing this issue in light of our recommendation regarding the threshold legal issue of whether, and under what circumstances, a reassignment may qualify as a reasonable accommodation.
