The malicious prosecution claim against the district atty. is dism'd w/out leave to amd. based on absolute pros ecutorial immunity, & the district atty. is dism'd from this action. 4. The excessivie-force claim, the claim that plf. was refused medical care after an assault, & a claim that he was harassed @ SCI-Camp Hill after he was falsely charged w /aggravated assault are dism'd w/out prejudice to pursuing those claims in No. 08-744. 5.
