July 7, 2010 Opinion or Order Filing 20 ORDER - IT IS HEREBY ORDERED THAT: The United States motion for default judgment is GRANTED. (a) Judgment shall be issued against Defendant Frank J. Sebastian for Federal employment, unemployment, and highway use taxes, interest and penalties for the taxable periods noted in judgment in the amount of $226,747.30 as of March 18, 2010 plus penalties and interest pursuant to 28 U.S.C. 6621(a)(2) after that date until the full amount is paid; (2) against Defendants Frank J. Sebastian and Kelly A. Sebastian for federal income taxes, interest and penalties for tax years 2002 and 2003 in the amount of $167,159.11 as of March 18, 2010 plus penalties and interest pursuant to 28 U.S.C. 1961(c) and 26 U.S.C. 6621(a)(2) after that date until the full amount is paid; and (3) against Defendant Margaret M. Trefz, precluding her from asserting an interest in the property that is the subject of this civil action. The federal tax liens are foreclosed. The Real Property be sold according to the order of Sale, free and clear of any right, title, lien, claim, or interest of any of the parties herein.
