However, only complaints which bring allegations against York Corporation or York International as a successor-in-interest to York Corporation, during this time period, are to be considered.3) Pltfs cross motion for partial summary judgment (Doc. 25) is DENIED as to Count I with respec t to any claims that fall outside the policy periodsmentioned above.4) Pltfs cross motion for partial summary judgment (Doc. 25) is MOOT with regard to Count II to the extent the relief requested is the same ascontemplated by Count I. To the extent t he claim is based on additional facts not clearly outlined in the complaint or the briefings, the parties shall have fourteen (14) days to file sur-reply briefs to the respective motions for summary judgment to more fully address the breach of contract cause of action.
