MEMORANDUM AND ORDER: 1) The motion to dismiss 10 is GRANTED with respect to Sotos claims against Dfts Michael Klopotoski and Jerome Walsh.2) Dfts Klopotoski and Walsh are DISMISSED as parties in this action.3) The motion to dismiss (Doc. 10) is DE NIED with respect to Sotos claims ofdeliberate indifference to his medical needs against Dfts Bureau of Health CareServices, Ellers, Ginocchetti, Harris, Leskowsky, and Waligun (DOC Defendants).4) The motion to dismiss 19 is DENIED with respect to Sotos claims ofdeliberate indifference to his medical needs against Dfts Bohinski and OBrien(Medical Defendants).5) The motions to dismiss (Docs. 10 & 19) are DENIED with respect to Sotosclaim that a policy or custom exists to avoid the high cost of treating prisoners medical concerns by delaying surgeries and treatment by outside specialists for so long that such treatments would not be possible.6) The remaining DOC Dfts and Medical Dfts are directed to file an answer to the complaint within (30) days of the date of this order.Signed by Honorable Sylvia H.
