MEMORANDUM AND ORDER granting 13 MOTION for Extension of Time to Amend. The plaintiff shall, therefore, file an amended complaint on or before July 30,2013. Since the complaint in this case will be amended, the original complaint will be a nu llity, and any motion to dismiss challenging a count contained in that original complaint will be moot. Therefore, we will DISMISS the pending motion to dismiss the plaintiffs first complaint (Doc. 3.) as moot, but without prejudice to the defendants renewing this motion as to any amended complaint.
