ORDER - In accord with the accompanying Memorandume 84 : Dfts mtn for summary judgment 37 is GRANTED with respect to Pltfs implied warranty claim and is DENIED in all other respects. Additionally, the parties mtns in limine are disposed of as foll ows:1. Dfts mtn for admission of felony conviction 39 , is DENIED;2. Dfts mtn to preclude expert witness 41 , is DENIED;3.
