No. 17), is DENIED as to Count I of Plaintiffs Complaint (Doc. No. 1-1); 3. Plaintiff and Defendant are directed to subm it, within fourteen (14) days of the date of this Order, briefs specifically addressing the impact of the Memorandum accompanying this Order on Count I of Plaintiffs complaint (Doc. No. 1-1) and Defendants counterclaim (Doc. No. 4); 4. Plaintiff and Defendant are directed file a responsive brief within fourteen (14) days after service of their respective briefs; and 5.
