Filing 9 ORDER (memorandum filed previously as separate docket entry)1. Plaintiffs Application for Leave to Proceed In Forma Pauperis (Doc.2) is GRANTED.2. Plaintiffs complaint is DEEMED filed.3. Plaintiff shall pay the full filing fee, based on the financialinformation provided in the Application for Leave to Proceed InForma Pauperis and the certified Prisoner Trust Fund AccountStatement. (Doc. 6). The full filing fee shall be paid regardless of theoutcome of the litigation.4. Pursuant to 28 U.S.C. 1915(b)(1) and (2), theSuperintendent/Warden, or other appropriate official at Plaintiffsplace of confinement is directed to deduct an initial partial filing feeof 20% of the greater of:(A) the average monthly deposits in the inmates prison accountfor the past six months, or(B) the average monthly balance in the inmates prison accountfor the past six months.The initial partial filing fee shall be forwarded to the Clerk of theUnited States District Court for the Middle District of Pennsylvania,P.O. Box 1148, Scranton, Pennsylvania, 18501-1148, to be credited tothe above-captioned docket number. In each succeeding month, whenthe amount in Plaintiffs inmate trust fund account exceeds $10.00,the Superintendent/Warden, or other appropriate official, shallforward payments to the Clerk of Court equaling 20% of thepreceding months income credited to Plaintiffs inmate trust fundaccount until the fees are paid. Each payment shall reference theabove-captioned docket number.5. The Clerk of Court shall SEND a copy of this Order to theSuperintendent/Warden of the institution where Plaintiff is presentlyconfined.6. Plaintiffs complaint (Doc. 1) is DISMISSED with prejudice pursuantto 28 U.S.C. 1915(e)(2)(B)(ii).7. The Clerk of Court is directed to CLOSE this case.8. Any appeal from this Order is deemed frivolous and not in good faith.See 28 U.S.C. 1915(a)(3).(eo) |
