For the reasons stated in the Court's #49 Opinion of this date, the Court GRANTS in part Defendants; #43 Motion to Dismiss to the extent it seeks to dismiss #34 Amended Complaint's claims against Defendant Sarah Young for want of personal jurisdiction. Accordingly, the Court DISMISSES the Amended Complaint's claims against Sarah Young without prejudice. As for the claims brought against Consumer Guardian Specialists LLC, d/b/a Credit Shield ("Consumer Guardian"), the Court, on the record at present, holds in abeyance its decision to grant Defendants' Motion to Dismiss as to Consumer Guardian pending completion of limited jurisdictional discovery regarding Consumer Guardians jurisdictional contacts with Pennsylvania. The parties will have sixty (60) days from the date of this Order to complete limited jurisdictional discovery regarding Consumer Guardian's contacts with Pennsylvania. This action will be stayed and administratively closed during that period of limited jurisdictional discovery and during the pendency of any renewal of the Motion to Dismiss as to Consumer Guardian. May 9, 2020 Opinion or Order Filing 24 ORDER Directing All Counsel to Straighten Things Out, and To Do It Fast. Well, in the last 48 hours or so, here is what has happened on the docket in this case. Plaintiff has filed a Stipulation of Dismissal with Prejudice #14 as to one Defendant, a Motion for Leave to File First Amended Complaint #15 , an Errata #18 to [14} saying that dismissal was to be without prejudice, and a Status Report accusing some other defendants of playing dodgeball with a process server #21 . The Court entered Orders approving the stipulations/errata at 17 and 20 . One of the Defendants, the one to be dismissed, Secure Account Service, LLC, having previously moved to dismiss, #7 , has now filed a Motion to Correct #22 accusing Plaintiffs counsel of making false statements to the Court (counsel uses fancier language, but that is what it means) saying that his client was to be dismissed with prejudice and that Plaintiffs counsel switched things up with the Court resulting in a dismissal (now) without prejudice, and followed closely by its Motion for Sanctions #23 that is not in compliance with Fed. R. Civ. P. 11. Bulletin from the Court: this is not how we do things in this Court. All counsel have until Noon, Monday May 11, 2020 to straighten this all out, and to file a document on the docket, electronically signed by ALL (everyone of them) counsel confirming that this is all resolved, and setting forth their solution.
