ORDER: 1.Plaintiffs motion for leave to proceed in forma pauperis #5 is GRANTED; 2.Pltf shall pay the full filing fee of $350.00 based on the per this order;3.The appropriate official at Pltfs place of confinement is directed to deduct an initial partial filing fee per this order.4.The Clerk of Court is directed to SEND a copy of this Order to the Super/Warden of the institution wherein Pltf is presently confined;5.The complaint #1 is DEEMED FILED;6.The Clerk of Court is directed to SERVE a copy of the complaint #1 , Pltfs declaration #2 , Notice of a Lawsuit and Request to Waive Service of a Summons (AO 398 form), Waiver of the Service of Summons (AO 399 form), and this Order on the named Dfts;7.If service is unable to be completed due to Ptfs failure to properly name the Dfts or provide an accurate mailing address for Dfts, Pltf will be required to correct this deficiency. Failure to comply may result in the dismissal of Pltfs claims against Dfts; and 8.The Clerk of Court shall SEND a Notice, Consent, and Reference of a Civil Action to a Magistrate Judge (AO 85 form) to all parties in the above-captioned action. The parties shall discuss consenting to the jurisdiction of a US Magistrate Judge. If all parties agree to consent to the jurisdiction of a US Magistrate Judge, then the parties shall complete and return the AO 85 form to the Clerk of Court no later ninety (90) days of the date of this Order.
