ORDER - it is hereby ORDERED that Magistrate Judge Bloom's report (Doc. 5) is ADOPTED. Gephart's complaint (Doc. 1) is DISMISSED for failure to state a claim and without prejudice. Plaintiff is granted leave to amend the complaint in conformity with Judge Bloom's report. In the absence of a timely filed amended complaint, the Clerk of Court shall close this case.
