MEMORANDUM AND ORDER that (1) Pltf Harmon's 6 Motion to amend title from Habeas Corpus to Order to Show Cause Due to Assault is DENIED. (2) This action shall proceed as a civil rights action pursuant to 28:1331 and (3) Harmon is directed to ei ther pay the filing fee or comply w/the Administrative Order of the Clerk of Court dated 10/14/08 if he wishes to proceed with this action.
