IT IS HEREBY ORDERED as follows: (1) Defendants' motions are GRANTED with respect to Count XII of Plai ntiff's Complaint (Doc. 1). Count XII is DISMISSED as to the moving defendants. (2) Defendants' motions are GRANTED with respect to Count XI of Plaintiff's Complaint (Doc. 1) to the extent this Count seeks attorney's fees and pu nitive damages under state law.
