To the extent that the pltf sought attorneys fees as sanctions, the motion is GRANTED, and the pltf shall make a submission addressing the considerations relevant to the awarding of attorneys fees set forth in this opinion, on or before August 15, 2011. 3. May 16, 2011 Opinion or Order Filing 102 MEMORANDUM AND ORDER - IT IS HEREBY ORDERED THAT: 1. The Department of Corrections motion for summary judgment (Doc.65) is DENIED with respect to Plaintiffs claims that the Department violated § 504 of the Rehabilitation Act by failing to accom modate her medical needs. The motion is GRANTED with respect to all other claims brought against the Department. 2. The Individual Defendants motion for summary judgment (Doc. 58)is DENIED with respect to Plaintiffs claims against the Individual D efendants in their individual capacities for alleged violations of the Pennsylvania Human Relations Act, 43 Pa. Cons. Stat. Ann. §§ 951 et seq. The motion is GRANTED with respect to all other claims brought against the Individual Defendants.Signed by Magistrate Judge Martin C. Carlson on May 16, 2011. (kjn )
February 9, 2011 Opinion or Order Filing 56 MEMORANDUM ORDER - Upon review of these requests for production, we believe that the Dfts observations and objections are well-taken. We will, however, ORDER that parties will confer regarding these requests for production, and endeavor to identify m ore narrowly tailored requests which can reasonably be honored by the Df ts on or before February 23, 2011. Finally, ODonnell alleges that she has not been provided with complete responses to interrogatories relating to affirmative defenses. In repl y, the Dfts claim that this motion is premature since the parties have not met and conferred to address these issues. Given the posture of this particular issue, IT IS ORDERED parties will confer and endeavor to resolve this matter without further li tigation on or before February 23, 2011. Finally, IT IS ORDERED that the parties be prepared to provide the Court withan update on the progress of these issues at the case management conference scheduled for February 18, 2011, at 11:00 a.m. In ligh t of these rulings, the Pltfs request for monetary sanctions is DENIED without prejudice to renewing this request if the Court find that the outstanding discovery issues are not satisfactorily resolved through the process outlined in this order.Signed by Magistrate Judge Martin C.
