IT IS HEREBY ORDERED that the Motion to Dismiss Plaintiff's Amended Complaint (Doc. 10) by Defendants the Borough of Hughestown, Paul Hindmarsh, and Robert Leombr uni is GRANTED IN PART and DENIED IN PART as follows: (1) As to Defendants Hindmarsh and Hughestown under Counts I and II, the Defendants' Motion to Dismiss will be DENIED.
