Filing 38 ORDER granting in part and denying in part 29 Motion for Summary Judgment Specifically, defendants motion for partial summary judgment is GRANTED as to plaintiffs Fourteenth Amendment claims under 42 U.S.C. §1983, plaintiffs claim against defe ndant Felsman under 42 U.S.C. §1981, plaintiffs conspiracy claim under 42 U.S.C. §1985(3), and plaintiffs state law claims for assault, battery, false arrest, false imprisonment and malicious prosecution.
