Filing 52 MEMORANDUM (Order to follow as separate docket entry).Based on the foregoing, the Court will grant Defendants Motion for Summary Judgment (Doc. 30) with respect to all claims against Defendant City of Scranton, and it will enter Judgment in favor of Defendant City and against Plaintiffs. The Court finds that Defendants Seitzinger and Mitchell are entitled to qualified immunity with respect to Plaintiffs Fourteenth Amendment procedural due process claim relating to their Ferdinand Street house , and it will grant Defendants Motion for Summary Judgment regarding this claim. However, the Court will deny Defendants Motion for Summary Judgment with respect to Plaintiffs Fourteenth Amendment procedural due process claim against Defendants Seit zinger and Mitchell regarding their Ferdinand Street garage. Further, Defendants Summary Judgment Motion will be granted with respect to Plaintiffs Fifth Amendment Takings Clause claim. The Court will deny Defendants Motion for Summary Judgment in regards to the Plaintiffs claim for punitive damages against Defendants Seitzinger and Mitchell in their individual capacities.
