Plaintiff's objections (Doc. 44), to the R&R are OVERRULED in part. Plaintiff's motion to amend (Doc. 47) is GRANTED. Defendants' motion to dismiss and/or in the alternative, for summary judgment, (Doc. 21), is GRANTED in part (see order for details). Plaintiff SHALL file an amended complaint, consistent with the Memorandum, within t wenty (20) days of the date of this Order. Plaintiff's motion for an extension of time, (Doc. 51), is DENIED as moot. This case is REMANDED to Magistrate Judge Mehalchick for further proceedings.
