November 13, 2012 Opinion or Order Filing 19 MEMORANDUM For the reasons discussed above, Defendants Palmerton Hospital and Lois Richards Motion to Dismiss (Doc. 9) is granted in part. It is denied to the extent that certain claims are dismissed without prejudice. Count I for breach of contrac t is dismissed with prejudice as to Defendant Richards and dismissed without prejudice as to Defendant Palmerton. Count II for wrongful termination is dismissed with prejudice as to Defendant Richards and dismissed without prejudice as to Defendant Palmerton. Count III for age discrimination under the ADEA is dismissed with prejudice as to Defendant Richards and dismissed without prejudice as to Defendant Palmerton. Counts IV and V for violations of the PHRA are dismissed with prejudice. An appropriate Order is filed simultaneously with this action. Should Plaintiff choose to do so, an amended complaint is to be filed within fourteen (14) days of the date of this Memorandum and simultaneously filed Order.
