Filing 9 MEMORANDUM - Based on the foregoing, Plaintiffs Complaint will be dismissed for failure to state a claim. Because Plaintiff is seeking his release from prison, no amendment to the Complaint would allow Plaintiff to state aclaim upon which relief may be granted, amendment would be futile, and thus, we shall dismiss the Complaint with prejudice. Additionally, we will grant Plaintiffs motion for leave to proceed in forma pauperis for purposes of screening. Because we have dismissed Plaintiffs Complaint, Plaintiffs motion for appointment of counsel will be denied as moot.Signed by Honorable Robert D. Mariani on 1/24/14. (jfg) |
