Filing 45 ORDER denying 31 Motion for Summary Judgment; granting in part and denying in part 34 Motion for Summary Judgment. The motion is GRANTED as to the FLSA recordkeeping violation based on failure to comply with 29 C.F.R. § 516.2(a)(8) and (9 ). The motion is DENIED in all other respects. Defendants are hereby enjoined from future violations of Sections 11(c) and 15(a)(5) of the Act, 29 U.S.C. §§ 211(c), 215(a)(5), and are specifically required to comply with the recordkeeping requirements set out in 29 C.F.R. § 516.2(a)(8) and (9).
