It is recommended that the plaintiffs 1983 claims against the POA and the Community Manager be DISMISSED for failure to state a claim upon which relief can be granted, pursuant to 28 U.S.C. 1915(e)(2)(B)(ii). It is further recommended that the action be dismissed without leave to amend, as it is clear from the facts alleged that any amendment would be futile. See Grayson v. Mayview State Hosp., 293 F.3d 103, 108 (3d Cir. 2002). Finally, it is recommended that the Clerk be directed to mark this case as CLOSED.
