MEMORANDUM and OPINION - In conclusion, the Court finds that the Lease was acommencement lease, and Defendant took sufficient action to commence awell within the original five-year term of the lease. Thereafter, Defendant drilled the well with due di ligence, such that it extended the Lease by its actions. As such, the Court finds in favor of Range on Good Will's claims for declaratory relief, ejectment, and trespass and will enter judgment in favor of Range and against Good Will on these claims. The Court further finds in favor of Range on Range's counterclaim for declaratory relief and will enter judgment in favor of Range and against Good Will on Range's counterclaim.Signed by Honorable Robert D.
