MEMORANDUM ORDER: IT IS HEREBY ORDERED that the 63 Motion for Summary Judgment filed by the Defendants is GRANTED in part and DENIED in part. The Motion is GRANTED with respect to the claims against Millcreek Police Department and with respect to the Plaintiff's race discrimination/equal protection claims. The Motion is DENIED with respect to the Plaintiff's Eighth Amendment excessive force claims against the individual Defendants. IT IS FURTHER ORDERED that the Clerk of Courts terminate the Millcreek Police Department as a Defendant from this action; adopting in part 82 Report and Recommendations. Signed by Judge Sean J.
