MEMORANDUM OPINION and ORDER granting in part and denying in part 33 Defendant's Motion for Summary Judgment; denying 38 Plaintiffs' Motion for Partial Summary Judgment. Summary judgment is GRANTED in favor of Defendant only as to Plai ntiffs' claim for actual damages under Section 35(a)(2) of the Lanham Act. Summary judgment in favor of Defendant is otherwise DENIED. Summary judgment is DENIED as to Plaintiffs' Partial Motion for Summary Judgment on Defendant's Affirmative Defenses. It is so ORDERED.
