Filing 29 MEMORANDUM OPINION AND ORDER OF JUDGMENT: AND NOW, to wit, this 30th day of September, 2011, for the reasons set forth in the accompanying Memorandum Opinion, IT IS ORDERED that the Defendants' Motion for Summary Judgment 17 be, and hereby is, GRANTED in part and DENIED in part as follows: 1. Said motion is GRANTED insofar as it relates to Plaintiff's federal claim premised upon alleged violations of the Securities Exchange Act of 1934 § 10(b) and SEC Rule 10(b)-5. As to this c laim, JUDGMENT shall be, and hereby is, entered in favor of Defendants Clarion Sintered Metals, Inc., Howard H. Peterson, and Benjamin F. Marzella and against Plaintiff Janice Casolo. 2. Said motion is DENIED insofar as it relates to Plaintiff' s state law claims for breach of fiduciary duty premised upon alleged acts of oppression, misrepresentation, and self-dealing.
