Filing 42 MEMORANDUM OPINION AND ORDER granting 2 Plaintiffs' Motion for Preliminary Injunction and granting in part and denying in part 17 Defendants' Motion to Dismiss. Consistent with the Findings of Fact and Conclusions of Law set forth in th e accompanying Memorandum Opinion, the following Order is hereby entered: Defendants Motion to Dismiss is granted as to Plaintiffs Warren County and AFA and denied as to Plaintiffs POGAM and Minard Run; the Forest Service is preliminarily enjoined fr om requiring the preparation of a NEPA document as a precondition to the exercise of private oil and gas rights in the ANF; enforcement of the forest-wide drilling ban in the ANF is hereby preliminarily enjoined; proposals for drilling activity shall instead be processed forthwith in the same form and manner in which they had been prior to the inception of the drilling ban and consistent with the procedures set forth in United States v. Minard Run Oil Co., 1980 U.S. Dist. LEXIS 9570 (W.D. Pa. 1980) and 30 U.S.C. § 226(o); and further implementation of the Settlement Agreement is hereby preliminarily enjoined. Signed by Judge Sean J.
