Defendants motion to dismiss [ECF No. 5] is granted with respect to the federal civil rights c laims set forth in Plaintiffs First, Second, Fourth, Fifth, and Sixth Claims for Relief and, accordingly, those claims are dismissed with prejudice. The state law claims set forth in Plaintiffs Third and Seventh Claims for Relief are dismissed witho ut prejudice. IT IS FURTHER ORDERED that Plaintiffs Third Motion for Declaratory Relief [ECF No. 15] is denied; that Defendants Motion for Sanctions [ECF No. 21] is denied; and that the Motion to Withdraw as Attorney [ECF No. 20], filed by Plaintiffs counsel, is dismissed as moot.
