More specifically: The motion to dismiss due to improper joinder is denied; The motion to dismiss based on the Younger abstention doctrine is denied; The motion to dismiss the due process claim based on false misconducts is granted; The motion to dismiss the due process claim based upon the missing property is dismissed as moot; The motion to dismiss t he Eighth Amendment claim based on verbal threats and harassment is granted; The motion to dismiss the retaliation claims is denied; The motion to dismiss some Defendants based upon lack of personal involvement is granted; and The motion to dismiss t he Pennsylvania Department of Corrections due to Eleventh Amendment immunity is granted. The Clerk of Courts is directed to terminate the following Defendants from this action: S.Dombrowski, Plaska, Overmeyer, Toski, Ennis, Ireland, Tice, and the Pennsylvania Department of Corrections.
