Defendant's motion to dismiss is GRANTED as to Plaintiff's claims of discrimination based on gender, religion, and national origin; the gender discrimination claim is dismissed; the religion and national origin claims are dismissed without prejudice. The motion to dismiss is DENIED as to Plaintiff's cla im of discrimination based on color. If Plaintiff chooses to file a curative amended complaint to reassert claims dismissed without prejudice, such amended complaint must be in accord with the Opinion accompanying this Order and be filed no later than 11/13/2013.
