OPINION & ORDER that Defendants motion to dismiss 11 be granted in part and denied in part. The motion is granted in that Plaintiff has failed to plead a claim against the City of Erie Police Department. The motion is denied in all other regards. I T IS FURTHER ORDERED that the Clerk of Courts terminate City of Erie Police Department as a Defendant to this action.
