Filing 30 MEMORANDUM OPINION & ORDER re 25 Renewed MOTION TO DISMISS FOR FAILURE TO STATE A CLAIM filed by CORRECTIONS OFFICER BAMBAUR, ERIE COUNTY PRISON, WARDEN ERIE COUNTY PRISON. The Court concludes that Binder has failed to exhaust his administrative remedies with regard to his claims brought in the Amended Complaint. Accordingly, summary judgment will be GRANTED in favor of the Defendants. A final judgment will therefore be entered in favor of Defendants and against Plaintiff Bi nder by separate Order in accordance with Rule 58 of the Federal Rules of Civil Procedure. Because the Court has determined that Binder failed to exhaust his administrative remedies, it is unnecessary to review the remaining arguments Defendants raise in their Motion to Dismiss.
