Filing 4 ORDER that Plaintiff's motion for leave to proceed in forma pauperis #1 is GRANTED. IT IS FURTHER ORDERED that Plaintiff's complaint be, and hereby is, DISMISSED as legally frivolous in accordance with 28 U.S.C. 1915(e)(2)(B). The dismissal, however, shall be without prejudice to Plaintiff's right to pursue his claims in a habeas corpus proceeding pursuant to 28 U.S.C. 2254. Accordingly, the Clerk of Court is directed to send Plaintiff the relevant 2254 forms and is further directed to mark this case CLOSED.
