ORDER denying #2 Motion to Dismiss, without prejudice, in light of the Court's Order (Doc. #5 ), entered today, which provides that "motions to dismiss must be accompanied by a certificate of the movant, stating that the moving party has made good faith efforts to confer with the nonmovant(s) to determine whether the identified pleading deficiencies properly may be cured by amendment," and warns that "[m]otions to dismiss that do not contain the required certification will be summarily denied." The Court appreciates Defendant's efforts to meet and confer with Plaintiff and advises Plaintiff that engagement in the meet and confer process not only benefits the litigants, in terms of conserving time and resources, but also is required by Court Order and must be respected as such. Defendant may refile the Motion to Dismiss, no later than 6/16/2023, but only after meeting and conferring with Plaintiff, and any such Motion must include the required certification.
