ORDER denying #8 Motion to Appoint Expert. As noted in the Court's order at ECF No. 4, this matter has been administratively closed pending Petitioner's payment of the filing fee or submission of a properly supported motion for leave to proceed in forma pauperis. Accordingly, Petitioner's request for appointment of an investigator is DISMISSED without prejudice. The Court will consider requests for discovery after Respondents have filed their answer. Petitioner may file a renewed motion for discovery within 30 days of service of Respondents' answer, which is also the date his reply to the answer is due. See Local Rule 2254.E.2. The Court will provide the parties with the opportunity to submit supplemental memoranda of law in the event that discovery is permitted and/or an evidentiary is held.
